The Libby sentence

Jeralyn Merritt has an excellent piece regards Scooter Libby's sentencing, which explains pre-sentencing guidelines and "departures" to legal dummies such as myself. She's predicting a split sentence with 5 months pokey, 5 months Martha Stewart Home Arrest. Others are predicting more.

Funny though, most lefty sites discussing the case make no mention of the precedent set in the Sandy Berger sentencing. Why is that?

The sentencing is June 5. Bush will be placed in a very precarious position if Judge Walton orders prison time and does not allow Scooter to remain free on bail pending appeal. Such a thing would probably force calls for an immediate presidential pardon but if he refuses there's a risk of sinking deeper in the tank with the home base while simultaneously trying to sell an unpopular immigration bill and maintain an unpopular war.
